Eminent Domain:
Eminent Domain is the power of the sovereignty to take private property for the public good. The sovereighty is usually the State or Federal government. In Florida, the state has given many of its agencies the power of eminent domain and has through legislation passed on the power to local governments and even to some private entities like utility companies. The Florida Constitution requires that the condemning authority pay "full compensation" for the taking. The Florida Statutes provide that property owners and business owners are entitled to have attorneys and other experts assist them without having to pay for their services. The condemning authority must pay reasonable attorneys' fees and experts costs.
